On May 10, 2007, the Harbin Intermediate People’s Court of Heilongjiang Province concluded the trial of a patent infringement case, in which Sun Junyi (the plaintiff) instituted legal proceedings against Ma Changyong from Renqiu City, Hebei Province, and Ms. Li from Harbin (the defendants).
The plaintiff claimed that he owned three utility model patents: “Exhaust Valve Seat” (Patent No. ZL99257124.3, granted on September 16, 2006), “Quick‑Joint Pipe” (Patent No. ZL02280674.1, granted on November 5, 2003), and “Anti‑Block Exhaust Valve” (Patent No. ZL200320112523.2, granted on November 3, 2004. Knowing the plaintiff’s legitimate patent rights, Defendants Ma Changyong and Ms. Li deliberately adopted the plaintiff’s patented technology to manufacture automatic exhaust valves. Suffering substantial economic losses caused by the defendants’ infringement, the plaintiff filed a lawsuit with the Harbin Intermediate People’s Court.
The plaintiff submitted sufficient evidence to the court. After court investigation and hearing, the court rendered the following judgments:

Defendant Ma Changyong shall immediately cease infringing the plaintiff Sun Junyi’s utility model patents of “Anti‑Block Exhaust Valve” (ZL200320112523.2) and “Quick‑Joint Pipe” (ZL02280674.1).

Defendant Ma Changyong shall compensate the plaintiff Sun Junyi for economic losses arising from the patent infringement in the amount of RMB 300,000. The compensation shall be paid within 10 days upon the entry into force of this judgment.

Defendant Ms. Li shall immediately stop selling products that infringe the plaintiff Sun Junyi’s utility model patents of “Anti‑Block Exhaust Valve” (ZL200320112523.2) and “Quick‑Joint Pipe” (ZL02280674.1).

Defendant Ms. Li shall compensate the plaintiff Sun Junyi for economic losses caused by the patent infringement in the amount of RMB 30,000. The compensation shall be paid within 10 days upon the entry into force of this judgment.
This court judgment has effectively curbed the arrogance of counterfeit producers and sellers.
