Helongjiang Province Harbin Intermediate People’s Court had finished judging the case that complaint Changchun Kuancheng Boiler Exhaust Valve Factory litigated defendants MaChangyongwho was in Renqiu City, Hebei Province, and Mrs Li who was in Harbin because of Trademark Intellectual Property Infringement on May, 10th, 2007.
Complaint said the Brand Zhongquan” was registered formally by this company on January 11th, 1991. It was awarded the famous trademark in Jilin Province between 2001 and 2006. It was awarded honorary certificate product and has been designated to reach international level by Jilin Province Technology Supervision Bureau in 1998 and the sales of product have already covered most of China. Defendants MaChangyong and Mrs Li ignored existence of law for their own benefits and they sold false “Zhongquan”Brand Exhaust Valves that produced by MaChangyong at Daowai District, Harbin City. It brought complaint a huge loss. So complaint appealed to Harbin City Intermediate People’s Court.
Complaint provided plenary evidence for the court. The court inquiry and hear the case, judgments as follows:
1、Defendant MaChangyong stopped to infringe trademark that Zhongquan registered at Changchun Kuancheng Boiler Exhaust Factory after the judgment took effect right now.
2、Defendant MaChangyong compensated complaint Changchun Kuancheng Boiler Exhaust Factory’s economy loss that trademark infringement with 300,000 yuan. The fine would be paid within 10 days after the judgment took effect.
3、Defendant Mrs Li stopped to sell products that infringed complaint’s trademark that Zhongquan registered at Changchun Kuancheng Boiler Exhaust Factory right now.
4、Defendant Mrs Li compensated complaint Changchun Kuancheng Boiler Exhaust Factory’s economy loss that trademark infringement with 30,000 yuan. The fine would be paid within 10 days after the judgment took effect.
The judgment of this court hit arrogance of people that produced and sold fake hard. |
