The Harbin Intermediate People’s Court concluded the trial of a patent infringement case, in which the plaintiff Sun Junyi filed a lawsuit against Dalian Mike Electromechanical Materials Station, Cheng ×lin, and Harbin Shijie Building Materials Store. The above defendants manufactured and sold “Xinquan Brand” exhaust valves that infringed the plaintiff’s patent No. ZL200320112523.2.

Upon court investigation and public hearing, the court delivered the following judgments:

1. Dalian Mike Electromechanical Materials Station and Cheng ×lin shall compensate the plaintiff Sun Junyi for economic losses of RMB 400,000 due to patent infringement within 10 days after the judgment takes effect.

2. Han ×jie, operator of Harbin Shijie Building Materials Store, shall compensate the plaintiff for economic losses of RMB 30,000 within 10 days after the judgment takes effect, for the manufacture and sale of “Xinquan Brand” exhaust valves involving patent infringement.

Relevant case background: Dalian Mike Electromechanical Materials Station and Cheng ×lin were once authorized dealers of Changchun Zhongquan Industrial Co., Ltd. (formerly Changchun Kuancheng Boiler Exhaust Valve Factory). In 2005, the company officially authorized them to sell patented “Zhongquan Brand” exhaust valve products.

The manufacturer of counterfeit “Xinquan Brand” exhaust valves was a Dalian science and technology development center, whose operator completed business registration with false identity documents. The center’s vice general manager “Li Mingwei” was a pseudonym, whose real name is Li ×xin. He once served as a sales manager at Changchun Zhongquan Industrial Co., Ltd.

Colluding maliciously, Cheng ×lin and Li ×xin jointly manufactured and sold valve products that infringed the company’s valid patents. Violating professional ethics, Li ×xin engaged in post-employment infringement, misappropriated the company’s trade secrets, and conducted unfair competition. Such illegal acts caused huge economic losses and severe reputation damage to Changchun Zhongquan Industrial Co., Ltd.

To effectively crack down on malicious patent infringement and unfair competition behaviors, the plaintiff formally filed a lawsuit with the people’s court. By legal means, the company severely punished the illegal manufacture and sale of patent-infringing products and unfair competition acts, and pursued the parties’ civil and corresponding criminal liabilities in accordance with the law.
