On February 2, 2009, the Xi’an Intermediate People’s Court concluded the trial of a patent infringement case. The plaintiff Sun Junyi filed a lawsuit against Hong Zhizhong of Nanguang Valve Factory (Yingdu Town, Nan’an City, Fujian Province), as well as Hong Weihuang and Hong Shiding of the Hot-water Heating Valve Supply Station (Xi’an City, Shaanxi Province). The above defendants manufactured and sold “Dingguang-brand” stainless steel exhaust valves, which infringed the plaintiff’s utility model patent No. ZL01251594.9.

Upon official court investigation and hearing, the court delivered the following judgments:

1. Defendants Hong Zhizhong, Hong Weihuang and Hong Shiding shall immediately cease all production and sales activities of products that infringe the plaintiff Sun Junyi’s utility model patent of “Automatic Exhaust Valve” (Patent No. ZL01251594.9).

2. The total case acceptance fee is RMB 1,000. Hong Zhizhong shall bear RMB 800 of the fee, while Hong Weihuang and Hong Shiding shall jointly bear the remaining RMB 200.

The “Dingguang-brand” stainless steel exhaust valve, which flowed into the market at the end of 2006, is a confirmed patent-infringing product. The product packaging falsely printed the manufacturer as “Fujian Huaying Valve Factory”, while the actual producer was Hong Zhizhong from Fujian Nanguang Valve Factory. The infringing products were privately produced in a family workshop, and Hong Zhizhong illegally counterfeited and embezzled the factory names and addresses of other enterprises.

To safeguard its legitimate patent rights and effectively crack down on malicious patent infringement and unfair competition acts, the plaintiff initiated judicial proceedings against the defendants’ illegal behaviors. Through judicial judgment, the company severely punished the malicious manufacture and sale of patent-infringing products, and pursued the infringers’ civil liabilities as well as corresponding criminal liabilities in accordance with national laws.

To thoroughly suppress the illegal arrogance of counterfeit producers and sellers, our company hereby makes a solemn announcement: Any person or entity that discovers the sale of “Dingguang-brand” exhaust valves or any acts of infringing Sun Junyi’s exclusive patent rights is welcome to report the situation to our company. Valid informants will receive a reward ranging from RMB 200 to RMB 5,000 according to the specific circumstances of each infringement case.
